CUSTOM LICENSE AGREEMENT
This Custom License Agreement (“Agreement”) governs the use of the ReadySetConnect application (“App”), a mobile application designed for therapists and educational organisations to manage client information, schedule tasks, set reminders, and perform other related tasks. By downloading, installing, or using the App, you (“User”) agree to be bound by the terms of this Agreement. If you do not agree, you must not use the App.
1. Grant of License
1.1 License: The App is licensed, not sold, to the User for personal, professional, and non-commercial use under the terms of this Agreement.
1.2 Limitations: Users may not modify, distribute, sell, or sublicense the App or its content. Any attempt to do so is a breach of this Agreement.
2. Disclaimer of Liability
2.1 General Information: The App provides features for managing client data, scheduling tasks, setting reminders, and organizing educational or therapeutic activities. It is not intended to replace professional advice or guidance in therapy, education, or any other field.
2.2 Accuracy: While the App aims to provide accurate scheduling and management features, no guarantees are made regarding the accuracy of scheduled tasks, reminders, or the management of user data. Users should verify the accuracy of all entries and scheduled activities independently.
3. User Obligations
3.1 Accurate Information: Users agree to provide accurate and up-to-date information (such as client details, tasks, and scheduling information) for the App’s functionality to work as intended.
3.2 Compliance: Users must use the App in compliance with all applicable laws and regulations, including but not limited to privacy, data protection, and intellectual property laws, as well as any industry-specific regulations.
3.3 Age Restriction: Users must be at least 13 years old to use the App. Minors must have parental or guardian consent to use the App.
3.4 Confidentiality: Users agree to maintain confidentiality regarding any sensitive or personal information entered into the App, including client data, and to comply with relevant confidentiality and privacy obligations, including those under HIPAA or other applicable privacy laws.
4. Subscription Plans
4.1 Pricing:
- Essential Single (1 Month): USD $47.99/month
4.2 Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
4.3 Cancellation: Users may manage subscriptions and turn off auto-renewal in their iTunes Account settings.
4.4 Charges: The User’s iTunes Account will be charged upon purchase confirmation and at the beginning of each renewal period.
5. Privacy Policy
The use of the App is subject to the Privacy Policy, which governs the collection, use, and storage of User data. By using the App, Users consent to the practices described in the Privacy Policy.
6. Limitation of Liability
6.1 No Warranty: The App is provided "as is" without any warranty of any kind, including accuracy, reliability, or fitness for a particular purpose.
6.2 Limited Liability: The App Developer is not liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the App, including any loss of data or failure in scheduling tasks or reminders.
7. Intellectual Property
The App, its design, and all related materials are the intellectual property of [Your Company Name]. Unauthorised use or reproduction is strictly prohibited.
8. Termination
This Agreement remains effective until terminated. The Developer may terminate the Agreement if the User breaches any term. Upon termination, the User must delete all copies of the App and discontinue its use.
9. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of [Your Jurisdiction]. Any disputes shall be resolved in the courts of [Your Jurisdiction].
10. Changes to Terms
The Developer reserves the right to update or modify this Agreement at any time. Continued use of the App constitutes acceptance of the revised terms.
BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO THIS LICENSE AGREEMENT.
